A) Special conditions of sale of equipment
WARRANTY
The warranty only covers failures caused by manufacturing or design defects, not including normal wear and tear elements. This warranty obliges the replacement of the damaged part free of charge, but does not include the labor necessary for its installation nor the travel expenses, which will be invoiced. The equipment must be operated according to the instructions in the manual supplied with it.
The machine, subject of warranty, must be operated and maintained in accordance with the corresponding instruction book, or failing that, in accordance with the rules specially issued by ATLAS COPCO and made known to the purchaser in each particular case.
WARRANTY PERIOD
For equipment, it is one year from the date of commissioning or eighteen months from the date of supply, whichever comes first; provided that the equipment is stored in accordance with Atlas Copco's standards, which shall be requested by the customer if necessary.
TOLERANCES
As per ISO 1217 ed. 4 2009 Annex C
Supplied free air + 5%
Specific energy + 6%.
Noise level according to PNEUROP PN8NTC 2.2: 2 dB
INSTALLATION OF THE EQUIPMENT
In the documentation delivered with the equipment, we provide a drawing of dimensions and installation recommendation of the equipment.
COMMISSIONING
It shall be carried out by ATLAS COPCO authorized personnel. It shall be carried out continuously during the course of one day within ATLAS COPCO's working hours. Expenses for allowances, travel expenses, any other service other than those specified, as well as delays during the commissioning due to causes not attributable to ATLAS COPCO, shall be invoiced at the prices in effect on that date.
In order to carry out the commissioning, the customer shall notify ATLAS COPCO sufficiently in advance, so that the service can be carried out without time delays and with adequate coordination by both parties.
LIMITATION OF LIABILITY
ATLAS COPCO, S.A.E.'s liability shall in any case be limited to 100% of the amount of the order. ATLAS COPCO S.A.E. shall not be liable for indirect and consequential damages such as, but not limited to, loss of profit, profit, contracts and/or production.
DATA MONITORING SYSTEM
The equipment may include a data monitoring system and a service called SMARTLINK. The data received by Atlas Copco through the system is used, among others, by Atlas Copco or contractors for the overall purpose of providing service to the customer. Both Atlas Copco and its contractors will use commercially reasonable efforts to protect the data from unauthorized use. The SMARTLINK service is provided “as is” without warranty of any kind, express or implied. Use of the SMARTLINK service is entirely at Buyer's risk. Atlas Copco reserves the right, at its sole discretion, to make necessary unscheduled implementations of changes, updates or upgrades to the SMARTLINK services at any time. Atlas Copco may add or remove functionality or features, and may suspend or stop the SMARTLINK service for any reason. Atlas Copco gives no guarantee that the SMARTLINK service will be 100% up all the time and shall not be liable in case of any downtime. More information about SMARTLINK can be found here
ATLAS COPCO EQUIPMENT ORDER CANCELLATIONS AND OVERHAULS
Cancellation Period: The customer has the right to cancel his order and receive a refund as provided below, depending on the type of equipment and cancellation notice periods:
Standard Equipment:
- Cancellation within 15 days from the date of receipt of order: The customer will not be penalized.
- Cancellation up to 2 weeks prior to the date of delivery of the equipment to the customer's premises: The customer will be charged a penalty of 20% of the total price of the cancelled order.
- Cancellation at the time of delivery of the equipment to the customer's premises: The customer will be charged a penalty of 30% of the total price of the cancelled order, to which will be added any expenses incurred, such as, but not limited to, shipping and disassembly costs.
Non-Standard Equipment (*)
- Cancellation within 15 days from the date of receipt of the order: The customer will not be penalized.
- Cancellation up to 6 weeks prior to the date of delivery of the equipment to the customer's premises: The customer will be charged a penalty of 60% of the total price of the cancelled order.
- After the sixth week, cancellation is not possible: Penalty of 100% of the total price of the cancelled order.
(*) Non-Standard Equipment is considered to be that equipment made specifically for the customer, and this shall be expressly provided for in the Quotation.
This policy applies unless otherwise agreed by both parties. The customer is advised to review these conditions before proceeding with the cancellation of the order.
B) Special conditions for spare parts only
DELIVERY TIME
The specified lead time depends on factory availability at the time the order is placed.
MINIMUM ORDER PRICE: 50,00 €
TRANSPORT COSTS
If we take care of them, they will be included in the total price of the quote and in the invoice.
WARRANTY PERIOD
For spare parts, it is 6 months from delivery.
RETURNS
If there are any errors in the shipment, please let us know immediately so that we can correct them. The maximum return period is one (1) month from the date of delivery, so please verify that the parts delivered conform to your order.
Any returns made due to errors beyond our company's control or unmarked parts (NS) will be credited at 90% of their invoice value.
Parts marked (NS) cannot be returned due to their uniqueness in our equipment, except for manufacturing failure during their warranty period. Therefore, before placing a firm order for these parts, please consult our Technical Assistance department if you have any doubts about their suitability, always providing us with the model and serial number.
SIGAUS
For the supply of oils, we will include the SIGAUS fee in our invoice. In accordance with RD 679/2006, SIGAUS is financed by a contribution from the member companies, depending on the oil marketed (0.06 €/kg), which must be passed on and broken down in the invoice to the next lubricant buyer.
